PRIVATE TUTORING AGREEMENT

1. Purpose of the Agreement
The purpose of this agreement is to formalise private tutoring services provided to the student. The goal of tutoring is to improve academic understanding, consistency, and performance through structured instruction and guided practice.

2. Scope of Tutoring Services
The Tutor agrees to: Provide curriculum-aligned academic instruction (CAPS); Identify and address learning gaps; Assign homework and revision tasks; Track progress and provide feedback; Maintain a professional and respectful learning environment. Tutoring does not guarantee specific marks or outcomes, as progress depends on student effort and consistency.

3. Student Responsibilities
The student agrees to: Attend all scheduled sessions punctually; Participate actively and respectfully; Complete assigned homework and revision; Bring required materials to each session; Communicate difficulties honestly.

4. Parent / Guardian Responsibilities
The Parent / Guardian agrees to: Ensure consistent attendance; Provide a suitable learning environment; Support homework completion; Communicate concerns or changes timeously; Fulfil all financial obligations.

5. Scheduling & Attendance
Sessions will be scheduled by mutual agreement. Missed sessions without at least 24 hours' notice may be forfeited. Repeated cancellations or non-attendance may result in termination of services.

6. Fees & Payment
Fee per session: R ______; Payment frequency: ______; Payment is due: ______; Late or missed payments may result in suspension of tutoring. No refunds will be issued for any payments made, except as required by law.

7. Confidentiality & non-disclosure
All information shared during tutoring - including academic records, discussions, strategies, reports, and personal details - is strictly confidential. No information may be shared with other tutors, tutoring companies, schools, or third parties without the prior written consent of the Tutor. All materials and academic strategies remain the intellectual property of the Tutor. Any breach of confidentiality constitutes grounds for immediate termination without refund.

8. Communication Boundaries
Primary communication regarding decisions rests with the Parent / Guardian. Student communication is limited to academic matters only. No tutoring will proceed without parental consent.

9. Termination
Either party may terminate this agreement with reasonable notice. The Tutor reserves the right to terminate immediately in cases of: Repeated non-attendance; Non-payment; Breach of confidentiality; Disrespectful conduct.

10. Limitation of Liability
The Tutor is not responsible for: School assessment decisions; Examination outcomes; Lack of progress due to non-compliance with responsibilities.

11. Governing Law & Jurisdiction
This Agreement shall be governed by and interpreted in accordance with the laws of the Republic of South Africa. The parties consent to the exclusive jurisdiction of the courts of the Republic of South Africa in respect of any dispute arising out of or in connection with this Agreement.

12. Amendments, Concerns & Special Conditions
Any amendments, concerns, or special conditions relating to this Agreement must be: Raised in writing; Discussed and agreed upon by all parties; Recorded clearly in the space below. No amendment or variation to this Agreement shall be valid unless documented in writing and signed by all parties.

13. Disclaimer
While the Tutor strives to improve the student's understanding and performance, results are not guaranteed. The Tutor shall not be held liable for any indirect or consequential losses arising from the tutoring services.

14. Acceptance & Signatures
By signing below, all parties confirm that they have read, understood, and agreed to the terms of this agreement.
